Regular Term Meeting
January 12, 2004

The Tallapoosa County Commission held its regular scheduled meeting at the Courthouse in Dadeville, Alabama at 9:00 a.m. on January 12, 2004. Commissioners Thomas L. Coley Jr., Charles Shaw, William Thweatt, and Johnny Allen were present. District Three Commissioner Dylan Oliver was absent.

Chairman Coley called the meeting to order.

Commissioner Shaw gave the invocation and led the Pledge of Allegiance.

Commissioner Shaw made a motion to approve the minutes of the December 8, 2003 meeting. Commissioner Thweatt seconded the motion. The motion passed unanimously. Minutes attached.

Commissioner Thweatt made a motion to approve the minutes of the December 19, 2003 meeting. Commissioner Shaw seconded the motion. The motion passed unanimously. Minutes attached.

Commissioner Shaw made a motion to approve the warrants. Commissioner Thweatt seconded the motion. The motion passed unanimously. Pay register attached.

Commissioner Thweatt made a motion to table the all bids for a 2003 Chevy Impala for the Sheriff's Department pending Sheriff Jimmy Abbett's recommendation. Commissioner Shaw seconded the motion. The motion passed unanimously. Bids attached.

Danny Lloyd of the Volunteer Fire Department Association requested that the Commission set a date for a task force meeting. Lloyd also asked the Commission to adopt a resolution requiring adequate pressure for fire hydrants. County Engineer, Dan Cook, stated that the resolution would require developers to place fire hydrants on subdivisions. Commissioner Thweatt made a motion to adopt the resolution. Commissioner Allen seconded the motion. The motion passed unanimously.

Chairman Coley set the task force meeting for January 20, 2004 at 6:00 p.m.

Commissioner Shaw made a motion to table the discussion of A.J.'s Community Club Inc. Lounge Retail Liquor Class 1 License until District Three Commissioner, Dylan Oliver, is present. Commissioner Thweatt seconded the motion. The motion passed unanimously. Application attached.

The Commission opened bids for Dump Trucks. The Commission received bids from Alabama Truck Company and Gulf Coast Truck and Equipment Company. Commissioner Thweatt made a motion to accept the Gulf Coast Truck & Equipment Co. bid, if they meet the specifications for tractors as well as dump trucks. Commissioner Allen seconded the motion. The motion passed unanimously. Bids attached.

Commissioner Thweatt made a motion to appoint John Dendy to the Jackson's Gap Water Authority Board. Commissioner Allen seconded the motion. The motion passed unanimously.

Anita Feltman of 911 reported 911's activities for the 2003 calendar year to the Commission. Feltman stated that she wants to report to the Commission on a monthly or quarterly basis. Report attached.

Commissioner Thweatt made a motion to seek proposals for a County website. Commissioner Shaw seconded the motion. The motion passed unanimously.

Sheriff Jimmy Abbett addressed the Commission concerning the U.S. Department of Justice Bullet Proof Vest Program Grant. He stated that the grant is a 50/50 grant. Sheriff Abbett requested that the Commission match the $2,500 that the Sheriff's Department has to buy 10 bulletproof vests. Commissioner Thweatt made a motion to grant Sheriff Abbett's request. Commissioner Shaw seconded the motion. The motion passed unanimously. Attachment.

Chairman Coley read a special recognition for the Martin Luther King Celebration Committee. Commissioner Thweatt made a motion to accept the recognition. Commissioner Shaw seconded the motion. The motion passed unanimously. Attachment.

Cindy Railey of EMA informed the Commissioner that EMA had received a grant for $4, 427 to help write the plans and training for the National Pharmaceutical Stockpile.

County Engineer, Dan Cook, requested permission to seek proposals from auction companies for the sale of dump trucks. Commissioner Allen stated that his biggest concern is the replacement date for the dump trucks. Commissioner Allen stated that he does not want to sell the dump trucks before they can be replaced. Commissioner Allen made a motion to table the approval until the February 9, 2004 meeting. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Oliver joined the meeting.

Commissioner Shaw informed the Commission that several Alexander City churches are participating in Revival America, an area wide revival, from January 25 through January 28, 2004. January 26, 2004 is Political Night. Commissioner Shaw stated that all elected officials are invited to attend. The meeting is January 26, 2004 at 6:30 at Benjamin Russell High School.

Commissioner Thweatt asked for an update on the Solid Waste Issue. County Administrator, Annette McGrady, stated that the County is not ready to move forward.

Commissioner Thweatt informed the Commission that the lot being cleared in the Industrial Park would be finished this week.

Commissioner Thweatt informed the Commission that there are two Volunteer Fire Departments in District 4. Commissioner Thweatt stated that neither of these have running water. The departments have to pump water from the river to fill up their water tanks. No decision was made.

Commissioner Allen made a motion to designate the Solid Waste Funds to the districts in the same percentage as the district mileage. Commissioner Thweatt seconded the motion. Each Commissioner discussed how this would affect his district. Chairman Coley called for a show of hands. Commissioner Allen, Commissioner Thweatt, and Commissioner Oliver voted to approve the motion. Chairman Coley and Commissioner Shaw voted to deny the motion.

Commissioner Shaw stated that two boat ramps in District 2, one at Piney Woods and one at New Hope Church that need new cables. Commissioner Allen stated that he built the ramps for former Commissioner Gerald McGill, and that Mike Lucas has repairing boat ramps in the past. Chairman Coley asked whether there is any money in the boat ramp fund. County Administrator, Annette McGrady stated that she would check the Boat Ramp Fund balance.

Commissioner Thweatt made a motion to surplus a trailer from District 4 for the Internet auction. Commissioner Shaw seconded the motion. The motion passed unanimously.

County Engineer, Dan Cook, informed the Commission that two dump trucks on GovDeals are not bringing in the anticipated responses, around $12,000. Commissioner Allen stated that the bids need to be higher than that. Discussion was held to wait until the last proposals are accepted.

Chairman Coley informed the Commission that the Courthouse will be closed Monday January 19, 2004 in honor of the Martin Luther King/Robert E. Lee holiday.

Commissioner Allen made a motion to adjourn. Commissioner Shaw seconded the motion. The motion passed unanimously. Meeting adjourned at 9:45 a.m.
