May 9, 2005

The Tallapoosa County Commission held its regular meeting May 9, 2005 at the Courthouse in Dadeville, AL at 9:00 a.m. All commissioners were present. The Alexander City Outlook was present.

Chairman Shaw called the meeting to order.

Chairman Shaw gave the invocation and led the Pledge of Allegiance.

Commissioner Allen made a motion to approve the April 11th minutes. Commissioner Thweatt seconded the motion. The motion passed unanimously. Attachment

Commissioner Allen made a motion to approve the warrants. Commissioner Coley seconded the motion. The motion passed unanimously. Attachment

Richard Wagoner with the Farmer's Market presented the Commission with posters and pamphlets. Wagoner stated that the Farmer's Market desire is to bring in growers and small farmers, not wholesalers. Wagoner requested that the Commission support the Farmer's Market. Commissioner Coley made a motion to support the Farmer's Market with a donation of $2,534.00. Commissioner Oliver seconded the motion. The motion passed unanimously.

Danny Lloyd with the Volunteer Fire Department Association addressed the Commission. Lloyd requested $5,000 in continued support of the VFDA. Lloyd discussed funding alternatives and reported that the VFDA just completed the closing on grants. Lloyd stated that some departments have received money from FEMA along with a 10% match. Commissioner Coley stated that the $5,000 came from the selling of the A&P building. Commissioner Coley stated that to continue with that support would be a challenge. Commissioner Thweatt stated that the 5cent Single Containment Tax was frowned upon initially, but it was placed in the Governor 's tax proposal and voted down. Attachment.

Charles Kelly addressed the Commission concerning the Tennis Courts at Dadeville High School. Kelly reported on the various costs of rebuilding the tennis courts. Kelly requested that the Commission donate the money for the base materials at a cost of $10,000. Commissioner Thweatt made a motion to donate the base materials and use money from his landfill account. Commissioner Allen seconded the motion. The motion passed unanimously.

Tracey Guidry with the Tallapoosa County Boys and Girls Club did not come to the meeting.

Commissioner Allen made a motion to proclaim May as Law Enforcement Memorial Month. Commissioner Coley seconded the motion. The motion passed unanimously. Attachment.

Vicky Griffen addressed the Commission concerning funding to take the Special Education class from Dadeville High School to Disney World. Commissioner Thweatt stated that it should be mentioned to the Board of Education first. Attachment.

Commissioner Allen made a motion to award the guardrail bid (# 111-FY2005-35) Alabama Safety Service. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Teresa Stacks- Hospital Board Request did not come to the meeting.

Commissioner Allen made a motion to deny the Retail Table Wine (on or Off Premises) License to Chuck's Marina, Inc due to noise complaints. If noise is controlled during the summer, the Commission will reconsider the application. Commissioner Thweatt seconded the motion. The motion passed unanimously. Attachment.

Commissioner Oliver made a motion to reject the Precast Culver bids. Commissioner Allen seconded the motion. The motion passed unanimously. . Attachment.

Commissioner Oliver made a motion to seek bids for Precast Box Culver. Commissioner Thweatt seconded the motion. The motion passed unanimously. Attachment

Commissioner Coley made a motion to obtain Right of Way on various roads in District 1. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Oliver made a motion to send out bids for Culvert Construction on Hackneyville Cut-Off. Commissioner Thweatt seconded the motion. The motion passed unanimously. Attachment

Chairman Shaw stated that he has enjoyed his turn as Chairman. He stated that every department has been extremely nice and a pleasure to work with. Commissioner Coley made a motion to accept Chairman Shaw's resignation. Chairman Shaw seconded the motion. The motion passed unanimously.

Commissioner Allen made a motion to appoint Commissioner Oliver as the new Chairman. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Allen made a motion to deny the Special Retail License for The Social and Supper Club at Blue Creek. Commissioner Coley seconded the motion. The motion passed unanimously. Attachment

Commissioner Shaw made a motion hire Rusty Marcell as the Accounts Receivable Clerk in the Commission Office. Commissioner Coley seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to approve 6 temporary employees for the Highway for a six month period. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Allen made a motion to approve pit option for the Michael Dillard for base material at $1.00/cubic yard. Commissioner Thweatt seconded the motion. The passed unanimously.

Chairman Oliver announced that the Courthouse will be closed for Memorial Day on May 30, 2005.

Chairman Oliver stated that from now on, if anyone wants to speak at the Commission meetings, that their name must appear on the agenda.

Commissioner Coley thanked Commissioner Shaw for his work as Chairman. Commissioner Allen also gave his thanks to Commissioner Shaw.

Dick Bransen questioned the Commission regarding the Unit System. Bransen asked if the Commission was working on the Unit System and whether the Highway department is working on private driveways. Chairman Oliver stated that yes, the Commission is working on the Unit System and no, the Highway department is not doing private driveways at this time.

Building Inspector, Larry Scott stated that Building Department exceeded its budget this past Friday.

Linda Harris, Revenue Commissioner, thanked Commissioner Shaw for his work as Chairman.

Commissioner Allen stated that something needs to be done regarding the Wall Street roof. Commissioner Coley made a motion to borrow the money to pay for a new roof and to pay it off when the bond money comes in. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to adjourn the meeting. Commissioner Coley seconded the motion. The motion passed unanimously.
