Regular Term Meeting
December 8, 2003

The Tallapoosa County Commission held its regular scheduled meeting at the Courthouse in Dadeville, Alabama at 9:00 a.m. on December 8, 2003. All commissioners were present.

Chairman Coley called the meeting to order.

Commissioner Shaw gave the invocation and led the Pledge of Allegiance.

Commissioner Shaw made a motion to approve the minutes. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Shaw made a motion to approve the warrants. Commissioner Allen seconded the motion. The motion passed unanimously.

A.J.'s Community Club Lounge Retail License was added to the agenda. A.J.'s had a license, but before it was renewed, the deadline passed. Sheriff Abbett brought attention to security issues. Tyrone Oliver, a representative of A.J.'s stated that security has been added. He stated that A.J.'s knew of the complaints and has spoken with the sheriff. Commissioner Oliver made a motion to table the discussion to until the January meeting. Commissioner Shaw seconded the motion. The motion passed unanimously.

Chairman Coley read a proclamation giving special recognition to Josh McAlister.

Chairman Coley presented a special tribute to the late Mr. Frederick William Hutchinson. Sr. Commissioner Shaw made a motion to pass the special tribute. Commissioner Thweatt seconded the motion. The motion passed unanimously. Attachment.

Chairman Coley presented special recognition to Rev. David and Mrs. Elizabeth Benton. Commissioner Shaw made a motion to pass the special recognition. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment.

Commissioner Allen made a motion to change the mileage rate to 37.5 cents per mile. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment.

Commissioner Shaw made a motion to adopt the 2004 Holiday Schedule. Commissioner Allen seconded the motion. The motion passed unanimously. Commissioner Shaw made a motion to deny personal leave days for the Mardi Gras holiday. Commissioner Oliver seconded the motion. The motion passed unanimously. Schedule Attached.

Dan Hart with the Volunteer Fire Department Association addressed the Commission. Hart thanked the Commission for the work session. He also requested another work session before the next commission meeting. Chairman Coley announced that the Commission has Auburn University working on the concerns of the VDF.

The Commission discussed the surplus property list. A chip spreader, distributor, crane, excavator, Tandem GMC dump truck, ½ ton Ford Truck, and an International Transfer truck were added to the list. Commissioner Allen made a motion to approve the surplus list. Commissioner Shaw seconded the motion. The motion passed unanimously. Current surplus list attached.

Commissioner Allen made a motion to award the asphalt tank bid to Alabama Tank, Inc. Commissioner Shaw seconded the motion. The motion passed unanimously. Bids attached.

Commissioner Thweatt made a motion to approve the contract for Seay, Seay, & Litchfield Architect for the Alexander City Courthouse Annex. Commissioner Shaw seconded the motion. The motion passed unanimously. Contract attached.

Commissioner Thweatt made a motion to approve the contract with Amanda Scroggins for the Russell Lands A&P Building at the appraised value. Commissioner Oliver seconded the motion. The motion passed unanimously. Contract attached.

Commissioner Thweatt made a motion to table the approval of the contract with ECE, Inc. for a 10 year Solid Waste Management Plan. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment.

Commissioner Thweatt made a motion to approve the Preliminary Platt of Emerald Shores Subdivision. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to approve the Preliminary Platt of The Preserve at Stoney Ridge. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to approve the Preliminary Platt of Pace's Bluff Subdivision. Commissioner Shaw seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to approve the Long-term Detention Subsidy contract with DYS. Commissioner Shaw seconded the motion. The motion passed unanimously. Contract attached.

Commissioner Thweatt made a motion to revise the agreement for project STP-AA-6217-(200)-Mad Wind Road Project. Commissioner Shaw seconded the motion. The motion passed unanimously. Revised agreement attached.

Commissioner Shaw made a motion to seek bids for a used car for the Sheriff's Department. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment.

Revenue Commissioner, Linda Harris thanked the Commission for approving the holiday schedule.

EMA Director, Joe Paul Boone informed the Commission that the EMA office has VHF and UHF radios in the office, and that radios will be in the trucks later on in the week.

Commissioner Oliver made a motion to pass a resolution authorizing County Attorney, E. Paul Jones to seek information regarding the Still Waters Fire Department Property Tax. Commissioner Shaw seconded the motion. The motion passed unanimously.

County Engineer, Dan Cook informed the Commission that the Saughahatchee Creek Bridge has been lowered to three tons. The official detour around the bridge is Lovelady Road. Funds will be provided to resurface Lovelady Road.

Commissioner Shaw thanked County Attorney, E. Paul Jones for hosting the meeting with the Volunteer Fire Departments.

Commissioner Thweatt addressed two topics: logging and littering. Commissioner Thweatt suggested that the Commission check into having out of town loggers get a permit from the engineer. Commissioner Thweatt also suggested pulling one man off the road crew to control littering. Commissioner Thweatt stated that the county needs to be kept clean.

Commissioner Thweatt made a motion to add December 26, 2003 to the Christmas holidays. Commissioner Shaw seconded the motion. The motion passed unanimously.

Commissioner Allen made a motion to adjourn. Commissioner Thweatt seconded the motion. The motion passed unanimously.
