Automobile and Boat Tags

In-State Title Transfers

  • Buyer must present the following documents: Original title signed over to buyer on back of title.Bill of Sale.
  • Buyer must present documents to local probate office within 20 days of purchase.
  • Buyer will pay the following fees: Title fee of $18.00 Sales tax of 2.1% of purchase price (if purchased from individual). Any applicable ad-valorem tax and license fees. Transfer fee of $1.25.
  • No Strike-outs or alterations are permitted in assignments.
  • All signatures must be identical to names on the supporting documents.

In-State Transfers When Previous Owner Is Deceased

  • If will was probated, buyer will present documents noted above along with"Letters of Testamentary."
  • If will was not probated, buyer will present a death certificate and a "Next if Kin" form which must include the notarized signature of the individual named as next of kin and a certificated copy of a death certificate.
  • All documents must have the signature of the above named individual, i.e., title, bill of sale, etc.

Expediting Tag Renewal

  • Residents of Montgomery County need one of the following items to renew a tag in the Probate Department.Renewal notice.Previous year's tag registration.Tag number.
  • New residents of Montgomery County who have moved from another Alabama County and who need to renew a license tag, must provide one of the following:Renewal notice from the previous Alabama county. Previous year's renewal notice from the previous Alabama county.
  • To register a new or used vehicle purchased from a licensed dealer in the State of Alabama, the following is required:Title application (copy).Itemized bill of sale (copy) showing sales tax break down.
  • To register a vehicle purchased from a licensed dealer from another State, the applicant must present:The car manufacturer's certificate of origin (if the vehicle is new).The original title (if the vehicle is used).Itemized bill of sale, name (s) of the individual (s) to whom the vehicle is beingregistered, and ...The vehicle itself for inspection.
  • To register a vehicle prior to and though 1974, the following items are required:A bill of sale, including date, price, vehicle ID number and previous owner'ssignature.Current registration from previous owner is helpful, though not required.
  • There are many special tags that may be purchased through the Probate Office. For precise fees and requirements, contact the Probate Office at 334-832-1233.
  • To register a vehicle with the gross weight of 55,000 lbs., or more a completed Schedule 2290 form (obtainable from the Internal Revenue Service) must be presented at the Probate Department.

Marriage Licenses

This information is provided for persons interested in purchasing marriage licenses in Montgomery County

General information

  • Both parties must be present to apply for a license (no blood test required).
  • License is $41.00 and is valid for 30 days from the date of issuance.
  • Applicants must provide a copy of the divorce decree.
  • Payments accepted: Cash

Guidelines for marriage licenses for persons 18 years or older:
Residents of Alabama

  1. Official Picture ID (passport, military ID, State issued ID, Driver License) or
  2. Certified copy of the state issued birth certificate and 2nd ID such as socialsecurity card
  3. Incarcerated applicant
    • Letter of approval from Warden for incarcerated person
    • ID for other party as listed for resident or non resident

Non Residents
NO EXCEPTIONS

  1. Official picture identification (passport, military ID, State issued ID, Driver License)
  2. U. S. Government issued Immigration Services ID Card (green card, visa, alien resident card, etc.). A birth record is not acceptable.

Guidelines for Issuance of Marriage Licenses for Minors 16 or 17 Years of Age

  • Both parents must be present or the custodial parent must provide a certified copy of divorce or legal document that grants care, custody, and control. No affidavits will be accepted in lieu of a missing parent.
  • A certified copy of the state issued birth certificate for the minor
  • Official picture identification for minor and parents(or legal guardian).
  • A social security card.

Hunting and Fishing Licenses

Requirements:

  • Licenses are required for Alabama residents 16 years old and under the age of 65 and non-residents 16 years and older. Proof of residency for ninety (90) days prior to purchasing a license is required to qualify for a resident license. Applicants must also have completed a Hunter Education Course given regularly by the Department of Conservation. Course information is from the department at 334-242-3467.
  • Applicants 65 years or older are not required to obtain a hunting and fishing license, but must have identification.
Business Licenses

Persons engaged in the operation of a business must obtain proper city and state/county license prior to beginning operation. A business operating outside the city limits may only be required to purchase a State/county license.

There are several differences in city and State/county licenses. A city license is issued at City Hall, while the State/county license is issued through the county in which the business is located. In Tallapoosa County, the State/county license must be purchased at the Office of the Judge of Probate at Tallapoosa County. State/county business licenses are valid for a fiscal year, i.e., October 1 through September 30. State/county licenses must be renewed by November 1 to avoid penalties and interest charges.

Many businesses are exempt from obtaining a State/county business license. A determination of exemption is made by the Business License Section of the Probate Office. Office hours are 8:00 a.m. through 5:00 p.m., Monday through Friday. Information may be obtained by calling 256-825-4266.

Driver Licenses

Persons who have never had an Alabama Driver License or ID card must apply at the Drivers License Examiner's Office.

Persons applying for a first driver license or for a Alabama identification card must provide two forms of identification. Contact the Examiner for a list of acceptable forms of identification. Persons applying for a driver license will be administered a written examination, an eye exam, and a road test. Persons moving into Alabama from another State may surrender the out-of-State license and take an eye examination. Persons wishing to obtain a identification card (including those with suspended Alabama driver licenses) must first apply at the Examiners Office. An administrative fee of $5.00 is required for each application.

To complete the application process, applicants will receive an issuance card that must be taken to one of the local Probate Offices. The fee for a license or identification is $23.00. A temporary license or ID card, with a picture, will be issued at the Probate Office. The original will be mailed at a later date from the Alabama Department of Public Safety. Persons not receiving their licenses within 60 days should contact the Department of Public Safety at 334-242-4400.

Persons with suspended driver license must apply to the Department of Public Safety for re-instatement. Upon payment of re-instatement fees, the applicant may obtain a duplicate driver license at any Probate Office in Alabama. Note: Two forms of identification are required.

Vessel Licenses

Persons 12 years and older operating motorized watercraft must have an operator's license. Information on certification may be obtained from the Alabama Department of Conservation by calling 334-242-3673. Certain restrictions apply.
