3/8/1999 - Regular Term Meeting

The Tallapoosa County Commission met in its regularly scheduled meeting at 2:30 p.m. at the Tallapoosa County Courthouse in Dadeville, Alabama on March 8, 1999. All members being present, Chairman Johnny Allen called the meeting to order.

Motion by Commissioner McGill, seconded by Commissioner Tapley to approve the February accounts payable. The motion carried unanimously.

Motion by Commissioner Coley, seconded by Commissioner Tapley to approve the minutes of the February 23, 1999 regular commission meeting. The motion carried unanimously.

Motion by Commissioner Tapley, seconded by Commissioner Coley, to approve the minutes of the February 25, 1999 special-called meeting with the following corrections: the time should read 5 p.m. rather than 4:30 p.m. and Commissioner Coley, rather than Commissioner Thweatt, seconded the motion to change position title to administrator. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner Tapley to appoint Harvey Tuner to serve on the Jackson's Gap Water Authority Board effective retroactive to March 1, 1999 and set to expire March 1, 2005. The motion carried unanimously.

Motion by Commissioner Tapley, seconded by Commissioner Thweatt to reappoint James L. Bassett to the Hackneyville Water Authority effective retroactive to March 1, 1999 and set to expire March 1, 2005. The motion carried unanimously.

Motion by Commissioner McGill, seconded by Commissioner Coley to not reenter into a contract with Columbus Recycling for the sell of recycled materials. The motion carried unanimously.

Commissioners signed a contract with Waste Management for the collection of solid waste in the county.

Motion by Commissioner Tapley, seconded by Commissioner McGill, to repair the bridge on Knight Road at an estimated materials cost of $16,278, to be for from the Road and Bridge fund. The motion carried unanimously.

Motion by Commissioner Tapley, seconded by Commissioner Thweatt, to allow Paul Jones to seek office space in Alexander City for the juvenile probation staff, and for the staff to move into said office space immediately upon its location. The motion carried unanimously.

Motion by Commissioner McGill, seconded by Commissioner Thweatt, to approve for two (2) correctional officers to attend Correction Officer's Training School. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner Tapley to approve the purchase and installation of equipment for new patrol vehicles. The motion carried unanimously.

Motion by Commissioner Tapley, seconded by Commissioner McGill, to approve a resolution in support of the county bridge bond issue. The motion carried unanimously.

Resolution No. 99-03-001
Whereas, almost 3,000 county-maintained bridges in Alabama have been classified as structurally deficient or functionally obsolete according to federal standards; and
Whereas, 96 or these bridges are located in Tallapoosa County; and
Whereas, the condition of many of these bridges is such a danger that commercial trucks and school buses are required to detour many miles to avoid crossing bridges posted with weight limits, with school buses across the state detouring more than 3,000,000 miles in a typical school year; and
Whereas, in addition to providing safe conditions for the citizens of this state, the repair or replacement of these bridges would have an enormous economic impact on Alabama's present and future economy; and Whereas, it is estimated that the cost of repairing or replacing all structurally deficient county bridges in the state of Alabama would be close to $300,000,000; and
Whereas, the Association of County Commissions of Alabama proposes a Rural Bridge Replacement Bond Issue to fund the repair or replacement of all structurally deficient county bridges in the state, with proceeds distributed solely on the basis of need; and
Whereas, it is proposed that this bond issue can be funded out of existing state and/or federal road and bridge funds.
Be it resolved by the Tallapoosa County Commission, that it strongly supports the county bridge bond issue and requests and encourages each member of the Tallapoosa County Legislative Delegation to support and vote for this bond issue once presented to the Alabama Legislature.
Bet it further resolved that copies of this resolution be sent to each member of the Tallapoosa County Delegation and to The Alexander City Outlook, The Dadeville Record and WZLM.
In witness whereof, the Tallapoosa County Commission has caused this Resolution to be executed in its name and on its behalf by its Chairman on this the 8th day of March, 1999.

Motion by Commissioner Allen, seconded by Commissioner McGill, to adopt the resolution and approve the contract allowing Local Government Revenue Enhancement Consultants (LGREC), Inc., to continue collections of sales tax for schools.

Resolution No. 99-03-002

A resolution establishing uniform administrative review and appeal procedures for the tax and license ordinances and any other tax and license ordinances that may be now or here after be adopted. This resolution may be referred to as the "Taxpayers Bill of Rights and Uniform Revenue Procedures Resolution."
The County Commission of Tallapoosa County does hereby adopt in whole Alabama Taxpayers' Bill of Rights and Uniform Revenue Procedures Act as promulgated by the State Department of Revenue except, where inapplicable.
Pursuant to Act 98-192, adopts in whole the rules and regulations as promulgated by the State Department of Revenue.
The effective date of this ordinance shall be March 8, 1999.
Approved this 8th day of March, 1999.

Motion by Commissioner Thweatt, seconded by Commissioner McGill, to send out bids for tandem trucks. Bids will be opened April 12, 1999. The motion carried unanimously.

Motion by Commissioner Tapley, seconded by Commissioner Thweatt, to approve a materials option with Bill Stephens for gravel from his property. The motion carried unanimously.

Motion by Commissioner Allen, seconded by Commissioner McGill, to approve an amendment to the county's subdivision regulations so as to include lots leased or sold for the use of mobile homes. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner McGill, for the county to, at the request of the association, participate by paying an equally assessed share (estimated at less than $2,000) for the expense of placing a new roof on the Association of County Commissions of Alabama office in Montgomery. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner McGill, to make the repairs to the county courthouse as recommended by the Grand Jury impaneled on February 8, 1999. Recommended repairs included: additional improvements to the downstairs restroom in order to accommodate the handicapped, as well as an additional stall; a larger and nicer chair for the witnesses in the grand jury room; a break room for employees and the grand jury; and more cameras for added security in the jail. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner Tapley, to pay overtime pay to county highway department personnel who worked on an emergency basis on February 28 & 29 to clear trees from roads as a result of severe thunderstorms. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner McGill, to solicit bids on a 20-feet reach boom mower if the item is not on the state bid list. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner McGill, to support the omnibus salary bill. The motion carried unanimously.

Motion by Commissioner Allen to buy two balers for recycling at a cost of $6,090. The motion died without a second.

Motion by Commissioner Allen, seconded by Commissioner Thweatt, to purchase nine (9)-mowing tractors through the state bid list. Tractors will be distributed accordingly: two in District 5, three in District 4, one in District 2 and three in District 3. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner Tapley, to enter into executive session as requested by Mike Lucas. The motion carried unanimously.

Commissioner Thweatt suggested, and the commissioners agreed, that the county hold a surplus property sale in the coming months. A date will be set at a later time; Dan Cook will be in charge of organizing the sale.

Motion by Commissioner Allen, seconded by Commissioner McGill, to see that the county's inventory records are up-to-date. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner Tapley, to purchase two balers for recycling. The motion carried unanimously.

Motion by Commissioner Allen, seconded by Commissioner McGill, to purchase a used Suburban or similar work-truck for the recycling department. The motion carried unanimously.

Motion by Commissioner Thweatt, seconded by Commissioner McGill to adjourn. The motion carried unanimously.
